General terms and conditions

§ 1 Scope

These terms and conditions apply to all purchase enquiries and contracts initiated between Steffen Klein (sole proprietorship) – hereinafter referred to as the “seller” – and the customer via the communication channels of the website mallorca-moebel.de and the associated domains (including muebles-baleares.es, balear-cargo.de, balear-cargo.es).

§ 2 Conclusion of contract (individual enquiry)

(1) The products presented on the website do not constitute a binding offer but an invitation to the customer to submit a non-binding enquiry.

(2) Following your enquiry (via WhatsApp, email or telephone) we check availability with the dealer as well as capacities for delivering our goods to Mallorca within our own-account transport.

(3) A binding contract is only concluded once we have prepared an individual offer for you and you have expressly accepted it (e.g. by confirming the message or paying the invoice).

§ 3 Prices and provision

(1) The prices stated on the product pages include statutory Spanish value added tax (IVA).

(2) The sold goods are delivered by the seller within the scope of its own own-account transport. The costs for provision and the logistical effort of delivery are calculated as a service fee and shown in the individual overall offer.

§ 4 Delivery conditions and reservation of self-supply

(1) Delivery takes place on the route Germany/Netherlands – Mallorca directly to your address or, if necessary, to our interim warehouse in 07420 Sa Pobla / Mallorca.

(2) Should the goods not be available from our supplier despite confirmation, we reserve the right to withdraw from the contract; payments already made are refunded without delay.

§ 5 Payment terms

Payment is made either by advance payment or bank transfer.

§ 6 Retention of title

The goods remain the property of Steffen Klein (sole proprietorship) until the total invoice amount has been paid in full.

§ 7 Liability and transport damage

(1) If goods are delivered with obvious transport damage, please report such defects to us immediately and document them photographically.

(2) Transport is carried out as own-account transport pursuant to § 1 (2) of the German Road Haulage Act (GüKG). Liability for the goods during transport by the seller is governed by the general provisions of sales law.

§ 8 Condition of the goods and warranty

(1) Special character of the range: The goods offered are high-quality pieces of furniture, one-offs or limited productions. They are expressly not industrially manufactured mass-produced goods.

(2) Relevance of the presentation: The condition of the goods is primarily determined by the object photos on the website. The customer is advised that slight deviations in colour and structure may occur in the digital presentation.

(3) Customer’s duty of care: Due to the individual nature of the pieces, the customer is asked to clarify any detailed questions before conclusion of the contract or to request additional photos if specific features are material to the purchase decision.

(4) Material-typical characteristics: The customer is aware that with the materials used (in particular solid wood and metal in industrial design) the following features do not constitute a defect in the legal sense:

  • Solid wood: natural knots, growth cracks as well as differences in structure and colour that can result from the natural “movement” of the wood.
  • Industrial design: characteristic features of manual processing such as visible welded joints, intentional grinding marks or production-related irregularities in the metal surface.

§ 9 Notice of defects and subsequent performance (Mallorca arrangement)

(1) Duty to give notice: The customer is obliged to inspect the goods for obvious defects upon delivery and to report these in writing without delay, enclosing meaningful photo documentation.

(2) Priority of subsequent performance: In the case of a justified defect, the seller has the right to subsequent performance. Due to the particular logistical situation on Mallorca, the seller reserves the right to have subsequent performance carried out by a qualified specialist company on site, provided this is reasonable for the customer and fully restores the value of the goods.

(3) Exclusion of price reduction for minor deviations: A reduction of the purchase price or withdrawal from the contract is excluded if there is only an insignificant deviation from the agreed condition which does not materially impair the function or the overall aesthetic impression of the individual piece.

§ 10 Final provisions

German law applies. The place of jurisdiction is, as far as legally permissible, Bad Homburg v. d. Höhe.
